Frequently asked questions
Which company form should we choose in Austria?
For most foreign businesses the choice is between a GmbH (limited liability company), a FlexKap (a newer flexible company form suited to start-ups and investor structures) and a branch office of the home company. Each has different capital, liability, tax and governance implications. We recommend the structure in this stage, with our legal and tax partners.
Can a non-EU citizen be the managing director?
Yes, and it is a common arrangement. What it requires is the right residence and work authorisation for that person, which is why the management structure and the immigration route are decided together in this stage rather than one after the other. We work the two through with our legal partners so the appointment and the permit fit each other.
Do we need to travel to Austria during Business set up & Structuring?
Usually not. This stage is preparation, and most of it is done remotely with documents exchanged securely. Some steps in the following stage, such as signing before a notary, opening the bank account or collecting a residence card, do generally need someone present. We tell you which ones and when as soon as the plan is fixed, so any travel is planned rather than sprung on you.
